They definitely should get the ticket (penalty). I don't think they should be disqualified unless there are a lot of "mistakes".

It was easy to do in the old days, too. Just forget to watch the dial,
or get confused about whether you were using the VFO in the T4-X or
the R-4.

But the point is that the op is supposed to be aware of what s/he is
doing, and not operate out the allowed band.
