In my opinion you have a legally binding contract which was breached. Although the retired attorney may know that you will not take the time and effort to sue his butt, you can contact the state bar association or the grievance committee and report him. He can then explain his "legal position" to his peers. Of course, if he no longer has a license then he can just laugh it off.
