HOA CC&Rs are one thing, Deed restrictions are entirely another. They run with 
the land. Any neighbor with a mind to do so can sue you.

When we were house-hunting in the mid-80s, we found our current home in a 
neighborhood that already sported a 90-foot crank-up tower and Hy-Gain 
tribander (K6IR/3 (SK).)  I figured that either the neighborhood's HOA rules 
were silent on towers or, if not, not enforced.  Turns out it was the latter, 
so we eventually bought just down the block from Ken.  I had no HOA trouble 
when I applied for a county permit and constructed my 64-footer in the back 
yard.  

Sometimes you get lucky.

Fortunately my 60-year-old subdivision's covenants, which forbid any 
"structures" without approval, are similarly moribund because of not 
being enforced.  In any case, my defense of my 5-year-old AB-577 
installation, should either the home-owners association or the county 
raise any question, is that  it's really just a temporary antenna 
support.  Take that!
