As many of you already know from my previous posts, I have been issued a
building and electrical permit for a tower here at my QTH. I have
already installed the tower and I am working on the electrical portion
of it. My neighbors (2 in particular) have complained to the city about
the tower. First the complaint was about RF exposure, which held no
water. Now it is strictly how ugly the tower and antenna is. One of the
neighbors told the city that I was supposed to get a conditional use
permit as well as a regular permit. The city attorney disagrees with
this from what I am told however. I am not an attorney but I read the
city codes and the neighbor may have a point. The city contacted me
today and wants to have a meeting on Monday with me and the zoning
officials. One thing that they mentioned is the possibility of putting
trees on the fence line that separates me and my neighbor behind me. I
wouldn't have a problem with that except for a few issues. The first
being that I live in a regular city lot and I am limited in space. I
placed my tower so that when I tilted it over,(it's a crank-up
tilt-over)there is only 5-10 feet between the top of the tower and the
fence that separates my yard from his. Also who will pay for upkeep of
the trees(trimming and such). How close to the fence will it have to be?
I have to keep up the fence because it is wood and needs pieces replaced
occasionally. How high will the trees have to go? I don't want them
interfering with the antenna or blocking the signal. There are other
issues but you get the idea. I think the city already asked the neighbor
about planting trees on his side of the fence, and I don't think that he
wants to. The bottom line is I am wondering if the city can revoke the
permit after issuing it, and me adhering with all of the cities codes.
This permit went through the zoning dept, building dept., and the
electrical dept. before it was issued. The city has codes limiting the
height of the tower to 55 feet, and the width of the tower to 18 inches
across. Any thoughts on this would be appreciated.
