There may or may not be a rule prohibiting having a friend hold your cq frequency while you go look on another band. There definitely is no rule that says *you* can't call CQ his frequency once he gives it up. If the abandoning station could expect someone to ignore his wish to give it to his "friend", the practice would stop.
