How would one measure the "damages" to compensate
for the illicit taking? What amount of compensation
is appropriate here?
This, of course, makes it easier easier for others
to disregard copyright notices and either re-publish
or plagiarize material from the web - as there is
often no pecuniary or other measurable loss to the
original author. While one can sue for an injunctive
order to preclude further publication, the cost
of legal action typically exceeds the value of the
material that is lifted, especially where pecuniary
compensatory damages would be inappropriate or
insufficient to deter the offending publisher.
