Ten Tec said they measured it. I would imagine they measured the noise
floor and saw a level that met spec
and that measurement would have included the birdies or tones as some are
calling them.
I didn't state that they necessarily measured the birdie itself. Maybe the
way I said it was a little misleading.

Possibly, Dan, but from your posting, TenTec "measured" the level of the
birdies not merely detected them by ear from listening. Of course, signals
in a negative S/N situation can be detected and their amplitude estimated,
but not readily. I would doubt that TenTec's service department and techs
would have the equipment and know-how to do so.
I am not trying to start a picky argument here, but I honestly think that
TenTec is being less than candid with you with the response that you
quoted.
Clearly, they did something in the 1.5 firmware that let a genie out of the
bottle that had been contained in 1.4. Let's hope that they clean it up
with 1.6.
