and the ones who
thought up the rules ought to have had enough sense to know
that they would

Are you actually saying if a particular group of people who
care less about their effect on the rest of the world is
intent on breaking the law, we should make no effort to
control it?
Perhaps the FCC gave more credit than they should have to
the people involved, and thought most people would use
common sense and follow rules. They probably overestimated
the radio-IQ of CB amp builders.
